DefendDefenders (the East and Horn of Africa Human Rights Defenders Project) presented to the 60th Ordinary Session of the African Commission on Human and Peoples’ Rights (ACHPR) the Overview of the Human Rights Situation in the East and Horn of Africa November 2016 – April 2017. This is the section on Somaliland.

Although there has been relative peace in Somaliland, the past year has seen an increase in violations towards HRDs and journalists who are critical of the government; they have faced intimidation, arbitrary arrests, and accusations of publishing false news.

Declaration by a Forum Discussion on Freedom of Media in Somaliland

On 26th and 27th April 2017, a Forum Discussion on freedom of media has taken place in Hargeisa, the capital of the Republic of Somaliland. Journalists, civil society organizations, professionals, the three political parties (Kulmiye, Waddani and UCID) and government officials participated the forum. The participants were sixty people representing all the regions of Somaliland, namely Hargeisa, Togdheer, Sanaag, Sool, Awdal and Sahil

The Forum extensively and deeply analysed the legal, economic and professional challenges facing freedom of media in Somaliland. After two days of candid discussions, the participants agreed the decriminalization of media, and acknowledged that media issues are complex and require all stakeholders to take their part in its development. The forum was hosted by Human Rights Centre with the support of the International Media Support (IMS). Somaliland Journalists Association (SOLJA) helped in organizing the event.

Somaliland: Human Rights Centre calls on the government to release detained opposition politicians

Somaliland government should immediately release two detained opposition politicians, Human Rights Centre said today in a press release.

On 11th April the police arrested Mohamed Sidiiq Dhame, the Youth Wing leader of Waddani opposition party, and Yonis Ahmed Yonis, the Sports Secretary of Waddani, at the regional office of the party in Hargeisa.

Human Rights Centre calls on the government to release journalist Abdimalik Mouse Oldoon

Human Rights Centre calls on the government of Somaliland to release Abdimalik Mouse Oldoon, a freelance journalist, who was arrested on 15th February by the government over accusations that he supported and campaigned for a presidential candidate in presidential election that took place in Mogadishu on 8th February, Human Right Centre said today in a press release.

Abdimalik was arrested after he returned from Mogadishu, sources confirmed to HRC. On 18th February he was brought to Hargeisa Regional Court which remanded him seven days in custody. On 26th February the court remanded him another seven days. He was not brought to court after the expiration of the seven days. He is now in Hargeisa Central Prison.

Human Rights Centre calls on the government to release journalist Mohamed Baashe Hassan

On 20th February 2017, about 10:30pm local time, the police of Somaliland arrested Mohamed Baashe Hassan, a prominent journalist and author, who is currently the director of Star TV. Human Rights Centre calls on the government to immediately and unconditionally release Mohamed.

Mohamed attended an event held at Maansoor Hotel Hargeisa to commemorate the Somaliland National Youth Day, which is the anniversary of 20th February 1982 when the military regime of Siad Barre cracked down students protesting against detention of educators. Mohamed was among the students who participated in the protest.

Somaliland: Court of appeals sets date for a case against Hubsad journalists

The government’s appeal against regional court judgment that acquitted Abdirashid Nour Ways, the chairman of Hubsad newspaper and the editor-in-chief, Saed Khadar Abdilahi, will be heard by Hargeisa Regional Appeal Court in 23rd January 2017, according to Abdirashid Nour Ways.

On 12th November 2016, Hargeisa Regional Court acquitted the two journalists who were accused of publication of false news and running unlicensed newspaper.

Privately owned internet providers block Hadhwanaagnews website

Two main private internet providers have blocked prominent news website in Somaliland since yesterday, 2nd January 2017. Hadhwanaagnews website media has been inaccessible to the users of Somcable and Somtel internets.

Hadhwanaagnews was blocked after it published news article claiming that the owner of Somcable, Mohamed Saed Guedi, provides financial support to the ruling party, Kulmiye. Somcable asked the website to remove the article.

Human Rights Centre Releases its 2016 Annual Report on the Situation of Human Rights in Somaliland

Today, 9th December 2016, the eve of the World Human Rights Day, Human Rights Centre published annual report to draw attention to the human rights situation in Somaliland. It covers the period from December 2015 to December 2016. It is being published not merely to criticise, but to make recommendations that might further enhance Somaliland’s human rights record, international reputation and build confidence with the public. Here is the summary of the report. Somaliland, a former British Protectorate, won its independence on 26 June 1960. It was recognized as an independent, sovereign state before it entered into what would become a failed union with Somalia on a flawed and dubious legal basis. The people of Somaliland, having suffered systematic discrimination and violence, decided to dissolve their failed union with Somalia on May 18, 1991 and reclaimed their independence. Since then, Somaliland has achieved peace by means of a bottom up approach, with little external help. It has built a democracy in which power changes hands peacefully in elections which are monitored internationally. It has put in place a system of governance which provides services to its people.

Somaliland: Indefinite detention of twenty four people without court order or trial

Human Right Centre calls on Somaliland government to release 24 people who are in detention since 17th June 2016 without charges. The 24 men were arrested from Ainabo district, Saraar region, on 17th June 2016 without court warrant. They are neither brought to court nor charged of any crime. Eighteen of them are held in Mandheera prison and six are in Ainabo prison. Chief Salaad Yuusuf Qodax, Chief Salaad Faarax Yuusuf and Chief Aadan Salaad Jaamac are among them. According to their families and other sources, the men who are elders were arrested after a man of their clan allegedly killed another man. The authorities demanded the clansmen to apprehend the suspect who escapade after the purported incident. They are not accused of involvement of the alleged killing.

Somaliland authorities arrest journalist in Buroa

Human Rights Centre (HRC) strongly condemns the arrest of Ahmed Mouse Sakaaro, journalist based in Buroa. Ahmed was arrested on 25th September 2016 at Buroa, east of Somaliland. The authorities accused Ahmed for inciting violence by urging the journalists “to defend themselves,” Togdheer Regional Police Commissioner told HRC. Ahmed recently condemned statement made by the Minister of Presidency who threatened to liberate from the country what he called pirate journalists. In response to the Minister, Ahmed called the journalists to stay vigilant and on guard.

Human Rights Centre expresses concern on prosecution of civilians before military court

Human Rights Centre calls on the government of Somaliland to stop prosecuting civilian people before military courts. Criminal case against Mohamed Amin Jibril, freelance journalist, Safiya Jibril, civilian person, and a policewoman is pending before the first instant military court in Hargeisa. They are charged of “insult and threats” for allegedly sending insulting and threatening text messages to a civilian person.
