Human Rights Centre files a discrimination case at court against Café Barbera Hargeisa

A lawyer with Human Rights Centre, Mubarik Abdi, acting on behalf of 15 years old child, filed a disability discrimination case at Hargeisa Regional Court against Café Barbera, Hargeisa.

The incident in question happened when a 15 years old child with a disability was denied access to Café Barbera on the grounds of his disability, according to eyewitnesses.

Article 8(2) of Somaliland Constitution prohibits discrimination on any ground and article 5(2) of the Convention on the Rights of Persons with Disabilities prohibits “discrimination on the basis of disability.” It requires states to “guarantee to persons with disabilities equal and effective legal protection against discrimination on all grounds.”

A judge at Hargeisa Regional Court was assigned to hear the case.

“This case is the first of its type ever presented to a court in Somaliland. We want to pursue justice on behalf of the child and to show all businesses in Somaliland that discrimination is not acceptable. We are determined to use the law to fight discrimination,” says Guleid Ahmed Jama, the chairperson of Human Rights Centre.

“I am grateful to the lawyer who is offering the legal aid representation,” he added.
